All services provided by Jason Koning (Aotearoa Web Design Ltd) are subject to the following terms and conditions.
Having said that I’m not prone to be overly pedantic about these things, fair is fair, and I’m open to gentlemen’s agreements.
Quotes and Estimates
Quotes and/or estimates will be honoured for 10 (business) days.
A new quote and/or estimate will then be provided upon request. Contracts that have been written, but not signed by the client will only be accepted within 10 (business) days of the delivery date.
A new contract will be drawn up upon request.
Charges and Fees
All new (or recurring work) that is $250 NZ or less can be paid by cash or direct credit – cheques are not encouraged.
All new web design projects that exceed $500 NZ can be split into three payments.
An initial deposit of 1/3 of the total project cost is due at contract signing.
A second payment of 1/3 the total project cost is due upon acceptance of the design.
The final balance will be due upon acceptance of the completed web development project – before it is released to the client or published to the internet.
Aotearoa Web Design Ltd retains the right to hold all graphics, and project development work (with the exception of content and graphics provided by the client), until payment is received for such items.
Web Site Design Credit
All Aotearoa Web Design Ltd clients will have a Design (and/or Development) by: Aotearoa Web Design Ltd link on their website – in the footer of no less than one page.
This is non-negotiable. By hiring me to work with you on your website you are agreeing to this, and you understand that this link may NOT be removed without my prior consent.
You may pay Aotearoa Web Design Ltd a one-off fee to have this link permanently removed.
Ownership and Copyright
Upon completion of the project, Aotearoa Web Design Ltd transfers all rights and ownership of CUSTOM designs and programming (by Aotearoa Web Design Ltd) to the client.
Software and third party graphics or programs are not transferred to the client, and remain under copyright of their respective owners or publishers.
Aotearoa Web Design Ltd reserves the right to resell custom designed websites that remain unpaid by the original client, unaccepted mock-ups or other graphics created by Aotearoa Web Design Ltd but not in legal use by the client.
Aotearoa Web Design Ltd reserves the right to display website’s and graphics that have been designed or built by Aotearoa Web Design Ltd on this website, and in any marketing material to aid as examples of my work.
Development and Delivery
Aotearoa Web Design Ltd understands the importance of completing projects in a timely manner.
Non Communication
If I am unable to communicate with a client on a project for an extended period of time (10 business days for example) – by phone or email, the project will be put on hold.
Liability
Services purchased from Aotearoa Web Design Ltd are provided “as is” without warranty of any kind.
In no event shall Aotearoa Web Design Ltd be liable to the client for any direct, indirect, special, punitive, incidental, or consequential damages arising out of the use of their website, services, and/or goods provided to the client. This includes, without limitation, lost profits, business interruption, loss of data or other losses directly resulting from the use of the website, services, and/or goods provided to the client. The entire risk as to the quality and performance of the web design rests with the client.
Having said that obviously I’ll work with you should anything require attention, note my previous mention above of gentlemen’s agreements.
Acceptance
Please note that by submitting the form below you are agreeing to all of my terms of service as written above.
Aotearoa Web Design Ltd reserves the right to change or update these terms at any time without prior notice.
